Concessions are administrative decisions which qualify for conducting business in the capacity in which freedom of business is normally limited. This decision is discretionary, which means that even if meeting all the conditions required for issuing the decision, the administrative body which issues the concession (the appropriate minister) may still refuse to do it. The areas of business which require a concession are specified by the act of law of
2 July 2004 on freedom of economic activity (Journal of Laws No. 173, item 1807 with later changes) and special acts of law.
Concessions are granted for a limited period of time, not shorter than 5 and not longer than 50 years, unless the businessman applies for a concession of a shorter duration. A treasury fee is charged for granting a concession or its later changes; the amount of this fee depends on the type of the concession.
